Types of Restraining Orders in Connecticut

Protective and restraining orders are designed to protect someone who has been a victim of violence. Most orders prohibit the alleged offender from contacting the alleged accuser and his/her family, staying away from the alleged accuser, preventing the alleged offender from entering the alleged accuser’s home or workplace, ordering temporary child custody rights, and more.

The following are the most common types of protective and restraining orders in Connecticut:

  • Family violence protective order – This type of protective order is issued during arraignment in criminal court. Most protective and restraining orders are issued in civil court.

  • Temporary restraining order – Also known as an “ex parte” restraining order, if an alleged victim and the judge believes there is an immediate and present physical danger to him/her, then the order will be issued the day the alleged victim applies. This order lasts until the court hearing to obtain a permanent order, which is typically held 14 days after the temporary restraining order is issued. But if the alleged offender possesses a firearm, then the hearing will take place in seven days.

  • Permanent restraining order – At the court hearing, if a judge decides in favor of the alleged victim, a permanent order will be issued. This order lasts up to one year or longer, depending on the judge’s discretion.

According to Connecticut law, violating a criminal protective order is a Class D felony, which is punishable by a maximum prison sentence of five years and a fine of up to $5,000. You will also be required to submit your DNA to the police.
